Martin - V-95-51 122 Red Brook Road <br /> Map 110 Block 66 <br /> A Petition was Sled on June 21, 1995 by Joseph P. and Jennifer H. Martin of <br /> Mashpee, Massachusetts for a Variance from Section 174-25.C.2 of the Zoning By-laws <br /> to allow the construction of a barn 87 feet from the rear property line in an R-3 zoning <br /> district on property located at 122 Red Brook Road (Map 110, Block 66)Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on July 7, 1995 and July 14, 1995, a copy <br /> of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 26, 1995 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Kenneth E. Marsters. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174- <br /> 25.C.2 of the Mashpee Zoning By-laws. <br /> Engineer John Slavinsky represented the applicant and explained that the lot <br /> contained 5.470 acres. He explained that the proposed barn would be 87' from the rear <br /> lot line and that the rear abutting lot is proposed for conservation land. The topography <br /> of the lot prevented any alternative locations for the barn. He stated that the proposed <br /> location would result in a setback of 246' from one sideline abutter and 244' from the <br /> other.sideline abutter and exceeded the 150' setback requirement in the By-law. <br /> Comments were received from an abutter in favor of the Petition. <br />
