Spurting - V-95-54 55 Redwood Circle Map 27, Block 97 A Petition was filed on July 21, 1995 by Daniel P. and Susan M. Spurting of Mashpee, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission to vary the sideline setback requirements to allow for a 2.2' setback. The applicant proposes to add a 14' x 37' deck to an existing dwelling on property located in an R-5 zoning district at 55 Redwood Circle (Map 27, Block 97) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on August 4, 1995 and August 11, 1995, a copy.of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, August 23, 1995 at 7:30 P.M. at which time the following members of the Board of Appeals were present and acting throughout: Edward M. Govoni, Kenneth E. Marsters and Robert G. Nelson. This Decision is issued by the Mashpee Board of Appeals pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 of the Mashpee Zoning By-laws. Mr. Spurting represented his application and explained that the proposed deck would be built on the side of the lot abutting the reserve area of the Mashpee Shores development. A letter was received from members of the owners' association in favor of the applicant and the Board was informed that the Conservation Commission has approved the plans. Mr. Spurting explained that the lot drops off on one side and that this was the only possible location for the deck.
