i <br /> Board of Appeals John's Pond Center Realty Trust SP-95-58 3. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded the Board of Appeals voted unanimously on September 27, 1995 to grant <br /> the modification of the Special Permit to allow a drive-in window subject to the following <br /> conditions: <br /> I. submission of a plan showing undisturbed buffer areas and detail of entrance. <br /> The Decision is referenced by plans of Cape and Islands Engineering revised <br /> October 2, 1995. <br /> 2. a marker be placed on the parking lot to show the point where no additional <br /> standing cars are allowed so as to limit stacking of vehicles in the drive <br /> 3. the entrance to the center from Nmigret Avenue be enlarged from thirty feet <br /> (30')to forty-four(44') feet. <br /> 4. the modification to the Special Permit to be reviewed by the Board of Appeals <br /> at the end of one year or sooner, at the applicant's request. <br /> The Board found that relief could be granted without detriment to the <br /> neighborhood or derogating from the intent of the By-laws. <br />
