Board of Appeals J. Patrick Riley NOA 95-59 2. <br /> The Board of Appeals made the following findings: <br /> I. the subject property consists of 11,588 square feet and fronts on John's Pond. <br /> 2. the immediate neighborhood consists of single-family homes on lots of similar <br /> size <br /> 3. the lot is impacted by wetlands and the only area approved for construction is <br /> the planned site of the house. <br /> 4. the lot has been maintained as a buildable lot on the Assessor's records and is <br /> assessed for$66,300. <br /> 5. the Board determined that, absent relief, the lot could not be used for a <br /> residence, the purpose for which it had been laid out and for which the balance <br /> of the lots in the area were being used. <br /> 6. the Board found that the proposed location met the earliest zoning <br /> requirements when the lot was formed. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> September 13, 1995 to reverse the Decision of the Building Inspector. The Board <br /> determined that the applicant was entitled to a building permit for a single family home <br /> and did not require a Variance. The Board found that the proposed construction would <br /> not derogate from the intent of the By-laws nor would it be a detriment to the <br /> neighborhood. This Decision is referenced with plans of Cape& Islands Engineering <br /> revised August 17, 1995. <br />
