Board of Appeals Alan and Charna Larkin 2. <br /> The Board of Appeals made the following findings: <br /> I. the subject property consists of 28,660 square feet and fronts on John's Pond. <br /> 2. the immediate neighborhood consists of single family homes <br /> 3. many of the lots in the area are much smaller than the subject lot. <br /> 4. the lot has been separately maintained on the Assessor's Records and is <br /> assessed as a buildable lot at $76,200. <br /> 5. the Board determined that, absent relief, the lot could not be used for a <br /> residence, the purpose for which it had been laid out and for which the balance <br /> of the lots in the area were being used. <br /> 6. the Board found that a literal enforcement of the By-laws would result in <br /> substantial hardship. The hardship relates to the size and frontage of the lot <br /> which was clearly intended to stand on its own and not as a part of the adjacent <br /> developed land. <br /> 7. the Board determined that desirable relief could be granted consistent with the <br /> planned area in which it is located. The Board found that relief could be <br /> granted without derogating from the intent of the By-laws or without <br /> detriment to the neighborhood or the Town. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously.on <br /> September 13, 1995 to grant a Variance in lot size and frontage to allow the construction <br /> of a single family home. The Decision is referenced by plans of Cape& Islands <br /> Engineering revised June 23, 1995. <br />
