Board of Appeals Gloria M. Stankowski - V-95-62 2. <br /> No comments were received from abutters. <br /> The Board of Appeals made the following findings: <br /> 1. the subject properties consist of three lots of 11,250 square feet each and one <br /> lot of 11,660 square feet on Ashumet Avenue. The area is now serviced by a <br /> public water supply and can accommodate the installation of a typical Title V <br /> septic systems. - <br /> 2. the subject properties are shown on plans of Ashumet Shores revised August <br /> 1965. The subdivision was in an R-75 zoning district which required lots of <br /> 7,500 square feet minimum. <br /> 3. the subject lots all exceed the 7,500 square feet <br /> 4. the lots have been separately maintained on the Assessor's Records and were <br /> assessed as separate buildable lots through 1994. <br /> 5. the Board determined that, absent relief, the lots could not be used for single <br /> family homes, the purpose for which they had been laid out and for which the <br /> balance of the lots in the subdivision are being used. <br /> 6. the Board found that a literal enforcement of the By-laws would result in <br /> substantial hardship to the Petitioner since most lots in the area are 11,250 <br /> square feet. <br /> 7. the Board determined that combining four lots into two lots would result in <br /> lots larger than most in the neighborhood and would not be a detriment to the <br /> community. <br /> 8. the Board found that the granting of a Variance would not derogate from the <br /> intent of the By-laws. <br /> Upon motion duly made and seconded, the Board of appeals voted unanimously on <br /> January 17, 1996 to grant a Variance in minimum lot size to allow the four lots to be <br /> combined into two lots. One lot would combine the lot on Map 41, Block 33 with the lot <br /> on Map 49,Block 107 and result in one lot of 22,500 square feet and 150 feet of frontage. <br /> The other lot would combine the lots on Map 49, Block 108 and Map 49, Block 109 and <br /> result in one lot of 22,910 square feet and approximately 163 feet of frontage. <br />
