McDonald for a Special Permit <br /> SP-94-3 <br /> A Petition was filed by John J. and Lillian R. McDonald <br /> of Mashpee, Massachusetts for a Special Permit under Section <br /> 174-17 of the Zoning By-laws for permission to expand a <br /> non-conforming dwelling with a 12' x 14 ' deck and a 14 ' x 24 ' <br /> garage in an R-3 zoning district on property located at 15 <br /> Shore Drive (Map 112 , Block 70 ) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on December 24 and <br /> December 31 , 1993, a copy of which is attached hereto and mado <br /> a part hereof . <br /> A Public Hearing was held on the Petition at the Mashpee <br /> Town Hall- on Wednesday, January 12, 1994 at 7 : 30 P.M. at which <br /> time the . following members of the Board of Appeals were <br /> present and acting throughout : John J. Friel, Michael A. <br /> Makunas and Edward M. Govoni . <br /> Mr. McDonald informed the Board that he planned to <br /> construct, a deck over an existing patio and add a garage to <br /> the property. He presented letters from two direct abutters <br /> in favor of the Petition. <br /> • <br /> The Board determined that the planned construction was in <br /> harmony with the general purpose and intent of the by-laws and <br /> complied with the provisions therein. The Board found that <br /> the proposed expansion would not be a detriment to the <br /> neighborhood and was consistent with improvements of other <br /> properties in the area . <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously on January 12 , 1994 to grant the Special <br /> Permit . The Permit is referenced by plans of Charles F. <br /> Jacobs dated November 6 , 1993 . <br />
