Priestley TR N .O.A.94-10 <br /> An Appeal of the Building Inspector' s Decision was <br /> filed on December 28, 1993 by Donald H. Priestley, Tr . <br /> appealing a Stop Work Order for a zoning violation in the <br /> construction of a single-family dwelling in an R-5 zoning <br /> district on property located at 135 James Circle (Map 71, <br /> Block 184 ) Mashpee, MA. (Owner of record: Richard M. <br /> Scudder TRS . ) <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. . Notice was given <br /> by publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee , on January 7 and <br /> January 14, 1994 a copy of which is attached hereto and <br /> made a part hereof . <br /> A Public Hearing was held on the Petition on <br /> Wednesday, January 26 , 1994 at 7 : 30 P.M. at the Mashpee <br /> Town Hall . Lacking a quorum to hear the Petition, the <br /> hearing was continued to March 2 , 1994 at which time the <br /> following members of the Board of Appeals were present and <br /> acting throughout : Michael A. Makunas , Cheryl A. Hawver and <br /> Jamie Regan. <br /> The applicant was represented by Attorney Robert <br /> Mills who informed the Board that a Building Permit had <br /> been issued in July 1993 for the construction of a single <br /> family dwelling on this lot and that the Building Inspectorw, <br /> had subsequently issued a Stop Work Order . <br /> The plans and other submission material were reviewed <br /> by the Board of Appeals . Throughout its deliberations, the <br /> Board of Appeals has been mindful of the statements of the <br /> applicant and his representative and the comments of the <br /> general public , all as made at a public hearing. <br />
