" MASHPEE, MA 02649 <br /> U.co^ <br /> RE: Notice of Appeal - Dream Developers NOA- 94-12 <br /> An Appeal of the Building Inspector ' s Decision was <br /> filed on December 28, 1993 by Dream Developers appealing a <br /> Stop work Order for a zoning violation in the construction <br /> of a single-family dwelling in an R-5 zoning district on <br /> property located at 211 James Circle (Map 71 , Block 169 ) <br /> Mashpee, MA. (Owner of record: Richard M. Scudder TRS. ) <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on January 7 and <br /> January 14 , 1994 a copy of which is attached hereto and . <br /> made a part hereof . <br /> A Public Hearing was held on the Petition on <br /> Wednesday, January 26 , 1994 at 7 : 30 P .M. at the Mashpee <br /> Town Hall . Lacking a quorum to hear the Petition, the <br /> hearing was continued to March 2 , 1994 at which time the <br /> following members of the Board of Appeals were present and <br /> acting throughout: Michael A. Makunas, Cheryl A. Hawver and <br /> Jamie Regan . <br /> The applicant was represented by Attorney Kevin <br /> Kirrane who informed the Board that the applicant had <br /> received a building permit for the construction of a <br /> single-family dwelling in July, 1993 and that the Building <br /> Inspector had subsequently issued a Stop work Order after <br /> the foundation had been poured. <br /> The plans and other submission material were reviewed <br /> by the Board of Appeals . Throughout its deliberations, the <br /> Board of Appeals has been mindful of the statement of the <br /> applicant and his representative and the comments of the <br /> general public , all as made at a public hearing. <br />
