Demers - V-94-17 <br /> A Petition was filed by Henry D. and Lisa M. Demers of <br /> N. Attleboro, Massachusetts for a Variance from Section <br /> 174-31 of the Zoning By-laws for permission to vary the <br /> front setback requirements in an R-3 zoning district on <br /> property located at 24 Tide Run (Map 126 , Block 29 ) <br /> Mashpee, Massachusetts . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on February 4 and <br /> February 11 , 1994 a copy of which is attached hereto and <br /> made a part hereof . <br /> A Public Hearing was scheduled on the Petition for <br /> February 23, 1994 and was cancelled due to weather and <br /> rescheduled for March 9 , 1994 at which time the following <br /> members of the Board of Appeals were present and acting <br /> throughout : Michael A. Makunas, Edward M. Govoni and <br /> Cheryl A. Hawver . <br /> Engineer Michael H. Grotzke represented the applicants <br /> and presented plans for a proposed house. He explained <br /> that an isolated wetland intrudes on the lot and that it <br /> was necessary to site the house away from the wetlands . The <br /> location will result in a 30 foot front setback from Tide <br /> Run instead of the required 40 foot under current zoning. <br /> He informed the Board that the original zoning of the area <br /> allowed 25 foot front setbacks . No comments were received <br /> in favor or opposed to the Variance . <br />
