Board of Appeals Donald R. MacLeod V-94-18 2.
The Board of Appeals made the following findings:
1 . the undeveloped lot contains 44, 834 square feet
and exceeds the R-3 zoning requirement of 40, 000
square feet . It is surrounded by lots of similar
or smaller size which have been developed with
single family dwellings.
2 . the unpaved ancient way is 33 feet wide and is
accessible to vehicular traffic and is typical of
many in the Town.
3 . other than a building lot, said lot could be put
to no other profitable use.
On the basis of these factors, the Board determined
that a literal enforcement of the By-law would involve
substantial financial hardship to the Petitioner and that
desirable relief could be granted without nullifying from
the intent or purpose of the zoning By-law and without
detriment to the public good.
Upon motion duly made and seconded the Board of
Appeals voted unanimously on March 9 , 1994 to grant the
Variance.
The Variance is referenced by plans of Cape and
Islands Engineering dated April 6, 1990 and signed as an
Approval Not Required plan on October 20 , 1993 .
6e6r c c`3u
E
2<'c
Z
a_ ._, _U. 2 ccuum Ta_o ate:= omce C8
Q 6 Z a+ c I c u «E oc 'c cO ecE— : aai m
u c e ° g
:cGc T
_` =.
cu :
: «C°4 e2
p i Vic « ppm, o5$smml $` Em caw `:i < y
Z
F '- 3 : _y3ye ^Sws
a'
c
i
8 O]t m 0 U « V
F2(: SB uE._ Cw '. ai < o. > uo. c u.
