IBoard of Appeals Joseph F. and Joan V. Crowe V-94-23 2. <br /> The Board of Appeals made the following findings: <br /> 1 . the location of the house on the petitioner's lot <br /> is unusual in the district in that it is 42 feet <br /> from the street in an area where most houses are <br /> 25 feet thus reducing the rear yard area; <br /> 2 . the proposed addition is the smallest practical <br /> size to accomodate the petitioner' s needs; <br /> 3 . this is the only place on the lot where an <br /> addition to the master bedroom could be <br /> constructed <br /> 3 . in the proposed location, the addition would <br /> encroach only two and one-half feet into the <br /> required 15 foot rear setback <br /> The Board determined that, owing to the shape of the <br /> lot, a literal enforcement of the rear yard setback <br /> requirements of the by-law would involve substantial <br /> hardship to the petitioner and that the rear yard setback <br /> may be reduced to twelve and one-half feet without <br /> substantially derogating from the intent of the by-law and <br /> without substantial detriment to the public good. <br /> Upon motion duly made and seconded the Board of <br /> Appeals voted unanimously on March 9, 1994 to grant the <br /> Variance of two and half feet allowing for a twelve and one <br /> half foot rear setback. <br /> The Variance is referenced by plans of Cape and <br /> Islands Engineering dated February 3, 1994 . <br /> '+7 :J O c' �.•r':� 3._ > _- `us == > n r n_ � _ _ c s as ', <br /> S]_ <br /> m 5 E, ° c _ _ r 3c c nc CN + _ _ '_ - : ' c.,�' + JBL ?E <br /> C Z ' = s_ ` c - c ' � n o` Lj=_ <br /> w <br /> na.
