Board of Appeals Joseph F. and Joan V. Crowe SP-94-24 2 . <br /> The Board of Appeals made the following findings : <br /> 1 . The changes between the existing dwelling and with <br /> the proposed addition are insubstantial although the <br /> proposed addition will result in a reduced rear yard <br /> _ setback thereby increasing the non-conforming nature <br /> of the structure. As a result this Board is required <br /> to make a determination under M.G.L. Ch. 40A, Section <br /> • 6 , regarding substantial detriment . <br /> 2 . The immediate neighborhood consists of single family <br /> homes of similar size and style to ,the, proposed <br /> structure . The existing structure conforms to all <br /> applicable setbacks with the exception of the rear <br /> and exceeds the front yard setback of many existing <br /> homes in the neighborhood. <br /> 3 . The lot abuts deeded reserve land in the rear which <br /> can never be built upon. <br /> The Board found that the proposed expansion would not <br /> be a detriment to the neighborhood and was consistent with <br /> improvements of other properties in the area. The Board <br /> determined that the plans of the proposed addition, its <br /> location on the lot, and the intended use of the structure <br /> comply with the general provisions set forth within the <br /> By-laws . . <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously on March 9 , 1994 to grant the Special <br /> Permit.
