MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION OF SPECIAL PERMIT 92-56 <br /> RE: Petition of Dick ' n Ellie ' s Flea Market <br /> Albert Wiseman, Manager SP-94-29 <br /> A Petition was filed by Dick ' n Ellie ' s Flea Market , <br /> =lbert Wiseman, Manager ,. for a Modification of Sections 4 . and <br /> 5 . of Special Permit 92-56 issued to Charles Talanian TRS . to <br /> allow tents to remain in place on the property and to allow a <br /> watchperson on the property daring the hours of 9 : 00 P .M. and <br /> 6 : 00 A.M. The Flea Market is located in a C-1 zoning district <br /> at 650 Falmouth Road (Map 81 , Block 4 ) Mashpee, MA. (Owner of <br /> record : Charles M. Talanian TR. ) <br /> Nntice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication, in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on March 25 and April 1 ; <br /> 1994 , a copy of which is attached hereto and made a part <br /> hereof . <br /> I •. <br /> A Public Hearing was held on the Petition at the Mashpee <br /> Town Hall on Wednesday, April 13, 1994 at 7 : 30 P .M. at which <br /> time the following members of the Board of Appeals were present <br /> and acting throughout : Michael A. Makunas, Edward M. Govoni and <br /> Jamie Regan. <br /> Mr . Wiseman represented the Petition and informed the <br /> Board that many of the flea market vendors put up tents for <br /> protection from the weather and that it was difficult to take <br /> them down on a daily basis . He proposed to have a uniform <br /> appearance for the tents with grey tops and blue sides . He <br /> also requested permission to allow a watchperson on the <br /> premises overnight to prevent vandalism. Comments were received <br /> iron, residents concerned about traffic and the appearance of <br /> the site . <br /> Upon motion duly made and seconded on April 13, 1994 the <br /> Mashpee Board of Appeals voted unanimously to allow a <br /> modification of Conditions 4 . and 5 . for one year only to be <br /> reviewed before the opening of the 1995 season .
