Silverman - V-94-36 <br /> A Petition was filed by Norman S . and Lois E. <br /> Silverman of Melrose, Massachusetts for a Variance from <br /> Section 174-31 of the Zoning By-laws for permission to vary <br /> the side-line setback requirements in an R-3 zoning <br /> district on property located at 9 Compass Circle (Map 105, <br /> Block 259 ) Mashpee, Massachusetts . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in The Enterprise, .a newspaper of general <br /> circulation in the Town of Mashpee, on May 6 and May 13, <br /> 1994, a copy of which is attached hereto and made a part <br /> hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, May 25, 1994 at 7 : 30 P.M. <br /> at which time the following members of the Board of Appeals <br /> were present and acting throughout : Edward M. Govoni, <br /> James E. Regan III and Arnold D. Mindick . <br /> Engineer David Sanicki represented the applicants and <br /> presented plans for a bedroom addition which will result in <br /> a side line setback of 5. 51 . He informed the Board that <br /> the house had been thought to be within the cluster zoned <br /> area of the New Seabury Special Permit but was found to be <br /> excluded. He explained that the shape and topography of <br /> the lot and the location of the septic system prevented <br /> expansion in any other direction. <br />
