` '�� ' f�• Town of Alaobpee <br /> 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> P , BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Petition of Rita Shaffer TR. - V-94-39 <br /> A Petition was filed by Rita Shaffer TR. of Mashpee, <br /> Massachusetts for a Variance from Section 174-31 of the <br /> " Zoning By-laws for permission to vary the setback <br /> requirements in an R-3 zoning district on property located <br /> at 101 Waterway (Map 105, Block 253 ) Mashpee, MA. (Owner <br /> of record: Rita Shaffer TR. Adnojo Trust ) . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on May 6 and May 13, <br /> 1994 , a copy of which is attached hereto and made a part <br /> hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, May 25 , 1994 at 7 : 30 P .M. <br /> at which time the following members of the Board of Appeals <br /> were present and acting throughout : Edward M. Govoni, <br /> James E. Regan III and Arnold D. Mindick . <br /> Mr . Shaffer presented plans for a proposed addition <br /> and the relocation of a guest house . He informed the Board <br /> that the house had been thought to be within the cluster <br /> zoned area of the New Seabury Special Permit but was found <br /> to be excluded. He explained that the new engineering <br /> plans indicated that his deck encroached on an adjacent <br /> lot. He requested to maintain the 3 . 7 ' side setback and a <br /> 1 ' side setback after deck was removed from the neighbor ' s <br /> property. <br />
