r � <br /> Town of Mashpee <br /> Planning Board <br /> Minutes of Meeting <br /> December 18, 1996 <br /> The Town of Mashpee Planning Board Meeting was called to <br /> order in the Great Room of the Carol H. Jacobson Senior Center, <br /> 500 Great Neck Road North, Mashpee, Massachusetts at 6:40 p.m. � . <br /> on Wednesday, December 18, 1996, by the Chairman, Anthony <br /> Ferragamo. <br /> Planning Board Members present: Anthony Ferragamo, <br /> Chairman; Dennis Balzarini; and Robert Govoni. <br /> Absent: John Kuchinski, Associate Member. <br /> Also present: Thomas Fudala, Town Planner; Eric Smith, <br /> Assistant Town Planner. <br /> Submission Definitive Plan/Covenant Release Request <br /> Joe Breen <br /> The Chairman declared a quorum to be present and called the <br /> Meeting to order. As the first order of business he recognized <br /> Mr. Breen with reference to the above captioned matter. The <br /> Chairman read a letter addressed to the Planning Board from <br /> Attorney Wall: °I represent Old Colony Estates, which is the <br /> owner of several parcels of land in Mashpee located off Route <br /> 28 shown on a Plan which is described, dated January 30, 1989, <br /> recorded at the Registry, etc. As you may or may not know, the <br /> parcel was permitted for the development of condominiums in the <br /> late 80 ' s--early 901s. Obviously that project was never actually <br /> developed. Now Old Colony Estates owns the parcels and would <br /> like to basically make a gift conveyance of open space to the <br /> Town of Mashpee in conjunction with developing two of the parcels <br /> into a cluster subdivision. Old Colony Estates intends to submit <br /> for your review a Definitive Subdivision Plan in the very near <br /> future. In order to accomplish the charitable conveyance of Lot <br /> 5, it is necessary for Old Colony to obtain a Release of Covenant <br /> currently on the land. Accordingly, I have enclosed for your <br /> consideration a standard Release of Covenant form. Your approval <br /> of this request would enable Old Colony to convey Lot 5 to the <br /> Town of Mashpee for open space purposes and would be greatly <br /> appreciated. " <br /> Mr. Fudala stated said donation has been accepted by theI <br /> Conservation Committee and approved by the Selectmen. <br /> The Chairman entertained a motion relative to Applicant' s <br /> request to release the Covenant on Lot #5. <br /> MOTION: Robert Govoni made a Motion to release the Covenant �1 <br /> on Lot #5 Subdivision Plan of Land-Old Colony Estates, Inc. - <br /> Mashpee, MA-Holmes & McGrath, Inc. -December 18, 1996; which pf . <br /> , <br /> a� <br />
