MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 8,2021 <br /> OTHER BUSINESS <br /> Sitting on this hearing are the four regular Board members and Robert Caggiano. <br /> 684 Falmouth Road: Petitioner, Andrew Enea requests a modification to an existing <br /> Special Permit(SP-07-55)for a change of use from retail to clinical,physical therapy(out- <br /> patient)under M.G.L.40A§9,and §174-25 D(2)of the Zoning Bylaws on property located <br /> in a C-1 Zoning District, Map 81 Parcel 24A, Mashpee, MA. (The Board to determine if <br /> considered a minor modification). <br /> Mr. Furbush discussed with the Board that there is an existing Special Permit at this <br /> location and they want to change the type of business and they are seeking a modification <br /> to allow this particular business that is a change of use. <br /> Mr. Goldstein said the original use was a retail flooring store. <br /> Mr. Furbush read an email dated Thursday, December 2, 2021 from Evan Lehrer, Town <br /> Planner into the record. He recommended that the applicant withdraw his permit <br /> modification because it does not require regulatory review as noted in Section 174-24(A) <br /> (4) a change to a use denoted by the letters PR/SP in Section 174-25: Table of Uses that <br /> does not propose construction of a new building or an addition of greater than 1,000 sq. ft. <br /> shall be allowed by right. <br /> Mr. Morris agreed with the Town Planner's recommendation. <br /> Mr. Goldstein read a letter dated December 3, 2021 submitted by Andrew Enea.requesting <br /> a withdrawal as recommend by the Town Planner and Building Commissioner. <br /> Mr. Bonvie made a motion that the Board accept the withdrawal submitted by Andrew <br /> Enea of 684 Falmouth Road. Mr. Gould seconded, yes, Mr. Caggiano, yes, Mr. Goldstein, <br /> yes, Mr. Bonvie, yes and Mr. Furbush. All were in favor to accept the withdrawal. <br /> Approve November 10,2021 Meeting Minutes. <br /> Mr. Reidy made a motion that the Board approve the meeting minutes. Mr. Gould <br /> seconded. All were in favor. <br /> ADDITIONAL TOPICS, <br /> (This space is reserved for topics that the Chairman did not reasonably anticipate would be <br /> discussed.) <br /> Mr. Goldstein asked the question why an applicant would require to apply under Section <br /> 174-33 of the bylaw if the project is within the New Seabury Special Permit. If <br /> Conservation approves the project, why would the application be in front of the Zoning <br /> Board? <br /> 5 <br />
