Szymanski Ctf.: 209225 <br />118 Wading Place Road <br />(Map I I I Parcel 110) <br />Mashpee, MA 02649 <br />A Petition was filed on September 28, 2021 by Owners, Steven J. and Tricia I. Szymanski <br />requesting a Special Permit under § 174-17.1 of the Zoning Bylaws to raze and replace an <br />existing single story non -conforming residential structure with a new two story residential <br />structure on property located in an R-3 Zoning District, at 118 Wading Place Road, Map <br />111 Parcel 110, Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br />40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br />circulation in the Town of Mashpee, on a copy of which is attached hereto and made a part <br />hereof. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br />Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br />Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br />November 10, 2021 at which time the following members of the Board of Appeals were <br />present and acting throughout; Chairman, Jonathan Furbush, Vice Chairman, William <br />Blaisdell, Board Members, Scott Goldstein and Norman J. Gould, and Associate Member <br />Brad Pittsley. <br />Attorney Keven Kirrane represented the homeowners for their raze and replace project. <br />Also present was Denise Bonoli, Architect for the project. Attorney Kirrane provided the <br />Board with the site plans, building plans, and a written presentation. The lot is a non- <br />conforming lot because it's only 15,400 plus sq. ft., and in this zoning district requires <br />40,000 sq. ft. The lot has been improved with a single-family residential structure, a <br />swimming pool, a shed, pier float and dock complex which runs along Popponesset and <br />Wading Place Road. <br />The single family residential structure is non -conforming in several respects. It fails to meet <br />the setback criteria on both sides of the building, and the existing structures exceed the <br />maximum lot coverage allowed under the bylaw. The existing condition plan shows the <br />front yard setback of 29.1 ft. making it non -conforming, a side yard setback on the <br />southwesterly side of the building as 9.7 ft., and on the northerly side of the building 7.9 <br />ft. which are all non -conforming conditions. <br />
