Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on November 12, 2021 and November 19, 2021 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> December 8, 2021 at which time the following members of the Board of Appeals were <br /> present and acting throughout; Chairman,Jonathan Furbush,Board Members,Ron Bonvie, <br /> Scott Goldstein,Norman J. Gould, and Associate Member, Brad Pittsley. <br /> Mr. Joseph Boncaldo represented the application requesting relief from the wetlands for <br /> reconstruction of a deck. He said the deck is existing but is in need of repair. He provided <br /> a plot plan depicting the 50 ft. setback from the wetlands. He said that when the house and <br /> deck were built the wetlands bylaw did not exist. He is planning to extend the deck 6 ft. <br /> forward, and 3 ft. to the left and will be within the required setbacks. He is just seeking <br /> relief from the 50 ft. setback. The Conservation Commission approved the project, and <br /> they visited the site and noticed that there are no footings beyond the foundation of the <br /> house. <br /> Chairman Furbush wanted an explanation of the particular line item on the site plan <br /> depicting the "proposed expansion to the deck". Mr. Boncaldo explained that it's called a <br /> "mulch sock"which will prevent seepage into the project area during construction. <br /> Mr. Reidy read the Conservation Commission comments into the record stating that the <br /> project was approved. <br /> 1 <br />
