�tan�h <br /> Town of Mashpee <br /> 16 Great JVeck koad Arth <br /> A'lashpee,Massachusetts 02649 <br /> '�edai+m uM� <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2022-06 <br /> Owners, Laurie Mancinelli and Doc.: 1429534 <br /> Joseph Mancinelli Ctf.: 226361 <br /> 18 Wilsons Grove <br /> (Map 118 Parcel 72) <br /> Mashpee, MA 02649 <br /> A Petition was filed on December 17, 2021 by Owners, Laurie and Joseph Mancinelli <br /> request a Special Permit under§174-17.1 of the Zoning Bylaws to raze and replace a single <br /> story, three bedroom dwelling and replace it with a new non-conforming code compliant <br /> three bedroom home on property located in the Popponesset Overlay District and R-3 <br /> Zoning District, at 18 Wilsons Grove, Map 118 Parcel 72, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on January 7, 2022 and January 14, 2022 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> January 26, 2022 as a hybrid meeting at which time the following members of the Board <br /> of Appeals were present and activing throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman <br /> J. Gould. <br /> Attorney, Kevin Kirrane represented the homeowners for two petition requests, one for a <br /> Special Permit for the raze and replace of the dwelling, and for Variance relief to exceed <br /> the 30 ft. height restriction. Attorney Kirrane took note of the various information <br /> submitted by certain Town Department Heads in the file suggesting that the height <br /> Variance is something that should not be granted. He had a discussion with his clients and <br /> it would make no sense given those comments, and asked his clients to revisit the design <br /> of the structure so that it conforms to the 30 ft. height restriction that is applicable in the <br /> Overlay District. He respectfully requested a continuance to allow some time to revise the <br /> plan and to withdraw the request for Variance relief. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> February 23, 2022, as a hybrid meeting at which time the following members of the Board <br /> of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman <br /> J.
