Town ofNashpee <br /> 041 <br /> 76 great Xec:k&ad Sorth <br /> MASHPEE ZONING BOARD OF APPEALS <br /> WITHDRAWAL OF A VARIANCE DECISION <br /> V-2022-07 <br /> Owners, Laurie Mancinelli and Doc.: 1429534 <br /> Joseph Mancinelli Ctf.: 226361 <br /> 18 Wilsons Grove <br /> (Map 118 Parcel 72) <br /> Mashpee, MA 02649 <br /> A Petition was filed on December 17, 2021 by Owners, Laurie and Joseph Mancinelli <br /> requesting a Variance under §174-31 of the Zoning Bylaws to vary the height requirement <br /> to allow for the raze and replace of a single family residence on property located in the <br /> Popponesset Overlay District and R-3 Zoning District, Map 118 Parcel 72, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on January 7, 2022 and January 14, 2022 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> February 23, 2022 as a hybrid meeting at which time the following members of the Board <br /> of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman <br /> J. Gould. <br /> Attorney,Kevin Kirrane represented the homeowners for the raze and replace project.Also <br /> present was Brian Foley, with Clancy Construction. The Board opened and heard <br /> preliminary discussion back in January at which time the Attorney presented information <br /> relative to the raze and replace project, as well as seeking a Variance to exceed the <br /> minimum height requirements that is provided under the bylaw. It was abundantly clear <br /> that the Board was not inclined to grant Variance relief relative to the height restriction <br /> after receiving certain department head comments. The plans were revised to eliminate the <br /> need for a height Variance, and were confirmed by the Building Commissioner and Town <br /> Engineer. <br /> Attorney Kirrane requested a withdrawal of Variance relief based on the revisions made to <br /> the plans and comments from the various department heads. <br /> 1 <br />
