Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee,on December 10,2021 and December 17,2021 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> January 12, 2021 at which time the following members of the Board of Appeals were <br /> present and acting throughout; Chairman, Jonathan Furbush, Vice Chairman, William <br /> Blaisdell, and Associate Members, George Ganzenmuller, Charles Reidy, and Robert <br /> Caggiano. Also present was Dave Morris, Building Commissioner, and Chris Gallagher, <br /> Town Engineer. <br /> Attorney Kevin Kirrane represented the homeowners for their raze and replace project <br /> located on a cul-de-sac in the Summersea section of New Seabury.Also present was Kevin <br /> Dauphinais with Sandbox Design Studio who designed the proposed project plans, and <br /> Andrew Garulay with Yarmouth Port Design Group,who designed the landscape plan. <br /> Mr. Kirrane provided the Board with the site plans and his written presentation. The lot <br /> consists of 10,900 sq. ft. and backs up along Ockway Bay as noted on the existing <br /> conditions plan, and constitutes a non-conforming lot. The lot has been approved for a 3- <br /> bedroom single story structure with a detached garage. The existing structure and garage <br /> are non-conforming in several respects including the side yard setback on the Southwest <br /> side of the lot, and the 50 ft. setback from the wetland resource areas. The lower level of <br /> the dwelling is below the flood elevations. The lot also exceeds the current lot coverage <br /> criteria of 20%,and is currently 23.43%. The accessory free standing garage does meet the <br /> current front and side yard setback criteria. <br /> 1 <br />
