MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owner, Thora J. Christo <br /> 54 Bayberry Drive (Map 23 Parcel 202) <br /> Mashpee, MA 02649 <br /> FINDING-2022-04 <br /> Attorney, Chris Kirrane represented the Petitioner, Mark Culhane,and the homeowners for <br /> the home improvement project. The Variance request is for the side yard setback, and a <br /> Written Finding for an addition to a pre-existing, non-conforming structure. He provided <br /> the Board with a written presentation and photographs of the property. There will be a two <br /> car garage, and a two bedroom second story on the Northeasterly side of the building, and <br /> a one story addition on the Southwesterly side. There's also a proposed covered porch. <br /> Attorney Kirrane said that the request for the front yard setback is not necessary because <br /> this setback is already non-conforming,and could be considered part of the application for <br /> the Written Finding. The project will be consistent with other structures in the <br /> neighborhood. The homeowner is requesting more space to accommodate her family. <br /> Chairman Furbush noticed that the rear of the property slopes and that there is a topography <br /> issue. He does not have any issues with the front or the right side setback facing the house <br /> from Bayberry. <br /> The Board read the comments into the record from the Board of Health Department, and <br /> Town Engineer. There were no issues. <br /> The DPW Director comments dated January 12, 2022 were read into the record. The <br /> Director stated that a curb cut permit is required for the driveway. The Board requested a <br /> revised site plan to be submitted for their approval depicting the corrected driveway <br /> conditions. <br /> The Board accepted the withdrawal for the front setback because it was considered a pre- <br /> existing non-conforming situation. There were no more comments from the Board. <br /> GENERAL CRITERIA <br /> The subject property located at 54 Bayberry Drive is approximately 14,120 square feet. <br /> There were no abutters present. <br /> 2 <br />
