MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> Owner, Thora J. Christo <br /> 54 Bayberry Drive (Map 23 Parcel 202) <br /> Mashpee, MA 02649 <br /> V-2022-03 <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> February 23, 2022, as a hybrid meeting at which time the following members of the Board <br /> of Appeals were present and acting throughout; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman <br /> J. Gould. <br /> Attorney Chris Kirrane represented the petitioner and homeowner for the Variance request <br /> of the proposed garage on the Northwesterly side of the property, and a covered porch in <br /> the front. He provided the Board with his written presentation explaining the details of the <br /> current conditions that exist on this particular lot. At the first hearing, the Board reviewed <br /> the application, and could not see a hardship to allow for the garage addition. Attorney <br /> Kirrane suggested to the Board that there was a topography issue in the rear of the lot <br /> because there is a significant slope, and it would be difficult to build a structure in the rear <br /> that may require large amounts of fill brought onto the property.Attorney Kirrane said that <br /> a variance for the front yard setback is not necessary because of the pre-existing, non- <br /> conforming situation that currently exists. He suggested that the Variance request is not <br /> creating a substantial detriment to the neighborhood or the public good. He is requesting a <br /> 5.6 ft. Variance for the side yard setback. <br /> The Board read the comments into the record from the Board of Health Department, and <br /> Town Engineer. There were no issues. <br /> The DPW Director comments dated January 12, 2022 were read into the record. The <br /> Director stated that a curb cut permit is required for the driveway. The Board requested a <br /> revised site plan to be submitted for their approval depicting the corrected driveway <br /> conditions. <br /> The Board accepted the withdrawal for the front setback because it was considered a pre- <br /> existing non-conforming situation. There were no more comments from the Board. <br /> GENERAL CRITERIA <br /> The subject property located at 54 Bayberry Drive is approximately 14,120 square feet. <br /> There were no abutters present. <br /> 2 <br />
