(Owners <br /> of Record: Gregory and Ivy Schantz). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee,on December 10,2021 and December 17,2021 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, <br /> January 12, 2022 at which time the following members of the Board of Appeals were <br /> present and acting throughout; Chairman, Jonathan Furbush, Vice Chairman, William <br /> Blaisdell, Associate Board Members, George Ganzenmuller, Charles Reidy, and Brad <br /> Pittsley. <br /> Steve Cook represented the homeowners for the proposed deck addition and extension <br /> project. The house is pre-existing non-conforming under the current bylaws. The existing <br /> house is 10.8 ft. from the West property line, and the lot coverage is conforming at 17.3%. <br /> The homeowners want to rebuild their deck located on the East side of the property in the <br /> same footprint,but will be moving towards the front lot line about 2 ft.which is conforming <br /> at 36.9 ft. away from the property line.The only change to their project is the covered porch <br /> addition that is 8 ft. x 34 ft. on the street side of the property. The house is odd shape that <br /> is angled along the property line. The porch is 10 ft. away from the West property line, and <br /> will be .8 ft. closer. The lot coverage will be at 20.4%because of the angle of the house. <br /> Chairman Furbush confirmed that the project does not require a Variance. <br /> Mr. Blaisdell said that he agrees that the project requires a Written Finding, and the Board <br /> will determine if the project is more detrimental than what currently exists. The lot <br /> coverage allowed in the Popponesset Overlay District is up to 25%. <br /> 1 <br />
