MA 02649 <br /> �`THOLE <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Kenneth Bates for a Special Permit SP-94-47 <br /> A Petition was filed by Kenneth Bates of Mashpee, <br /> Massachusetts for a Special Permit under Sections 174-17 and 174-20 <br /> of the Zoning By-laws for permission to construct a home on a non- <br /> conforming lot in an R-3 zoning district on property located at 16 <br /> Jeep Place (Map 118, Block 104) Mashpee, Massachusetts. <br /> Notice was fully given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general circulation <br /> in the Town of Mashpee, on June 24 and July 1 , 1994, a copy of <br /> which is attached hereto and made apart hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 13 , 1994 at 7:30 PM at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Edward M. Govoni and Robert-.G. Nelson. <br /> Attorney Mark C. Gildea represented the applicant and reviewed <br /> plans for a year-round home to replace an older home. The <br /> Petitioner submitted an as built plan of the pre-existing structure <br /> certified by an engineering and a plot plan (foundation plan) of <br /> the proposed structure certified by an engineer-Cape 6 Islands <br /> Engineering. The Petitioner also submitted architectural plans <br /> prepared by Artisan Architecture, 195 Washington Street, Weymouth, <br /> MA 02188 . The Board reviewed photographs of many homes in the <br /> area which were similar in size and design. It was determined that <br /> the proposed lot coverage would be less than 208 Comments were <br /> received from abutters through submission of letters. <br /> Throughout its deliberations, the Board of Appeals has been <br /> mindful of the statements and submission of the representatives of <br /> the applicant, and any abutters, and any comments of the general <br /> public, all as made at the Public Hearing. <br />
