Luconi - V-94-56 <br /> A Petition was filed by Fred and Suzanne M. Luconi <br /> of Concord, Massachusetts for a Variance from Section <br /> 174-25 . 1 . 9 of the Zoning By-laws for permission to vary <br /> the pier length requirements on property located in an R-3 <br /> zoning district at 116 Popponesset Island Road (Map 112 , <br /> Block 5 ) Mashpee, Massachusetts . ( Owner of record: <br /> Edward W. and Esther D. Donovan) . <br /> Notice was duly given to abutters in accordance <br /> with Massachusetts General Laws Chapter 40A. Notice was <br /> given by publication in The Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee on July 8 and <br /> July 15 , 1994 , a copy of which is attached hereto and made <br /> a part hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, July 27 , 1994 at 7 : 30 P .M. <br /> at which time the following members of the Board of <br /> Appeals were present and acting throughout : Edward M. <br /> Govoni , James E. Regan III and Cheryl A. Hawver. <br /> Engineer Jeffrey Johnson represented the applicant <br /> and presented revised plans for the construction and <br /> maintenance of a pier, ramp and float . He explained that <br /> the Conservation Commission had requested the revisions <br /> and it was necessary to exceed the 70 ' pier length <br /> limitation in order to minimize environmental effects . <br /> Findings : <br /> a . General : <br /> 1 . the proposed dock will be accessory to a <br /> dwelling situated on a 35 , 000 square foot lot <br /> on Popponesset Bay. The parcel is situated in <br /> the R-3 zoning district , and an accessory pier <br /> is a permissible use within that District upon <br /> grant of a Special Permit from the Zoning Board <br /> of Appeals . <br />
