Petti - N.O.A. - 94 - 57 <br /> A Petition was filed by Elizabeth R. Petti of Mashpee, Massachusetts Appealing <br /> the Decision of the Building Inspector denying a building permit in an R-3 zoning district <br /> onproperty located at 25 C ood Road <br /> (Map 117, Block 180)Mashpee, <br /> Massachusetts. The denial was based on the determination by the Building Inspector that <br /> the lot does not meet the requirements of Section 174-21 of the Zoning By-laws or MGL <br /> Chapter 40A, Section 6. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise a newspaper <br /> of general circulation in the Town of Mashpee, on August 5 and August 12, 1994, a copy <br /> of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 24, 1994 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Cheryl A. <br /> Hawver and Robert G. Nelson. <br /> Attorney Robert G. Clark represented Dr. Petti and informed the Board that the <br /> Building Inspector had nofified Dr. Petti on June 16, 1994 that the subject lot, also known <br /> as Lot 8, was not buildable. Attorney Clark reviewed the ownership of the lot and <br /> explained that it was purchased in 1970 by Rosina E. Petti and Elizabeth R. Petti <br /> together with an adjacent parcel on which a house had been built. The Board took the <br /> Appeal under advisement and granted extensions in the hearing calendar to allow time for <br /> legal research and deed searches. <br />
