�s <br /> 1NF.T21 <br /> ToWn of Alaobpee <br /> \\:- j• 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Christopher Foss for a Special Permit SP-94-63 <br /> A Petition was filed by Christopher Foss of Concord , <br /> Massachusetts for a Special Permit under Section 174-17 of <br /> the Zoning By-laws to allow the relocation of a <br /> non-conforming garage in an R-3 zoning district on property <br /> located at 417 Monomoscoy Road (Map 124 , Block 59 ) Mashpee . <br /> Massachusetts . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise , a newspaper of general <br /> circulation in the Town of Mashpee , on August 5 and August <br /> 12 , :994 , a copy of which is attached hereto and made a part <br /> hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday . August 24 , 1994 at 7 : 30 P .M. <br /> :.t which time the following members of the Board of Appeals <br /> were present and acting throughout : Edward M. Govoni , John <br /> J . Friel and James E . Regan III . <br /> Engineer William Madden represented the applicant and <br /> informed the Board that the applicant plans to relocate an <br /> existing garage to allow better access . The new location <br /> would be 10 ' from the side property line and is consistent <br /> with some of the side line setbacks in the neighborhood . Mr . <br /> Madden was informed that he would have to return to <br /> Conservation for approval to remove a tree to allow for the <br /> relocation . <br /> Comments were received from an abutter stating that <br /> the garage was only five years old but he did not object to <br /> the relocation . Another abutter questioned if the garage <br /> doors were to be moved which would require that more trees <br /> be cut and he was informed that this cannot be done without <br /> Conservation Commission approval and that the Permit is <br /> referenced by an official pian. Mr . Madden agreed to certify <br /> that the existing garage door configuration will remain as <br /> is . <br />
