�s 1NF.T21 ToWn of Alaobpee \\:- j• 16 GREAT NECK ROAD NORTH MASHPEE, MA 02649 DECISION FOR A SPECIAL PERMIT RE: Christopher Foss for a Special Permit SP-94-63 A Petition was filed by Christopher Foss of Concord , Massachusetts for a Special Permit under Section 174-17 of the Zoning By-laws to allow the relocation of a non-conforming garage in an R-3 zoning district on property located at 417 Monomoscoy Road (Map 124 , Block 59 ) Mashpee . Massachusetts . Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise , a newspaper of general circulation in the Town of Mashpee , on August 5 and August 12 , :994 , a copy of which is attached hereto and made a part hereof . A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday . August 24 , 1994 at 7 : 30 P .M. :.t which time the following members of the Board of Appeals were present and acting throughout : Edward M. Govoni , John J . Friel and James E . Regan III . Engineer William Madden represented the applicant and informed the Board that the applicant plans to relocate an existing garage to allow better access . The new location would be 10 ' from the side property line and is consistent with some of the side line setbacks in the neighborhood . Mr . Madden was informed that he would have to return to Conservation for approval to remove a tree to allow for the relocation . Comments were received from an abutter stating that the garage was only five years old but he did not object to the relocation . Another abutter questioned if the garage doors were to be moved which would require that more trees be cut and he was informed that this cannot be done without Conservation Commission approval and that the Permit is referenced by an official pian. Mr . Madden agreed to certify that the existing garage door configuration will remain as is .
