C <br /> Board of Appeals Christopher Foss 2 . <br /> The Board of Appeals , after carefully considering all <br /> of the facts and evidence submitted at the hearing, made the <br /> following findings : <br /> 1 . the subject property is located at 417 Monomoscoy <br /> Road amd contains 18 , 000 square feet fronting on Little <br /> River . <br /> 2 . the immediate neighborhood consists of single <br /> family homes of similar size . <br /> 3 . there will be no changes in the footprint of the <br /> garage and the changes in the side line setbacks will not <br /> increase the non-conformities . <br /> 4 . the site is both adequate for the proposed use and <br /> provides sufficient land area for parking and setbacks . <br /> For the foregoing reasons the Board determined that <br /> the applicant met the criteria necessary to grant a Special <br /> Permit . The Board found that the proposed expansion would <br /> not be a detriment to the neighborhood and that the proposed <br /> reconstruction, its location on the lot , and the intended <br /> use of the structure comply with the. general provisions set <br /> forth within the By-laws . <br /> Upon motion duly made and seconded the Board of <br /> Appeals voted unanimously on August 24 . 1994 to grant the <br /> Special Permit subject to the following conditions : <br /> 1 . the applicant receive Conservation Commission <br /> approval for tree removal <br /> 2 . the relocation of the garage conform to plans of <br /> G.A.F . Engineering signed August 24 , 1994 and that the <br /> existing garage door configuration remains as it is . <br />
