Hanlon for a Variance V-94-67 <br /> A petition was filed by Paul W. Hanlon of Wakefield, <br /> Massachusetts for a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the lot size <br /> requirements to allow the construction of a single-family <br /> dwelling in an R-3 zoning district on property located at <br /> 61 Cappawack Road (Map 72 , Block 19 ) Mashpee , <br /> Massachusetts . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on September 9 <br /> and September 16 , 1994 , a copy of which is attached hereto <br /> and made a part hereof . <br /> Y:, <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday. September 28 , 1994 at 7 : 30 _ <br /> P.M. at which time the following members of the Board of <br /> Appeals were present and acting throughout : Edward M. <br /> Govoni , James E. Regan III and Cheryl A. Hawver . <br /> Attorney Kevin M. Kirrane represented the applicant <br /> and explained that the applicant wishes to construct a 26 ' <br /> x 34 ' Cape style home . He explained that the lot is a <br /> pre-existing non-conforming undeveloped lot adjacent to a <br /> developed lot under the same ownership . He informed the <br /> Board that Mr . Hanlon purchased both lots in 1988 and at <br /> that time the undeveloped lot was protected as a buildable <br /> lot under the Mashpee Zoning By-laws . <br /> Comments were received from abutters in favor of the <br /> application. <br />
