MA 02649 <br /> ABLE CO FAY <br /> I, BOARD OF APPEALS <br /> Decision <br /> for a Special Permit <br /> RE: Robert Caggiula - SP-94-70 <br /> A Petition was filed Robert Caggiula of Dedham. <br /> Massachusetts for a Special Permit under Section <br /> 174-25 . 1 . 9 of the Zoning By-laws for a. prefabricated <br /> aluminum dock on John' s Pond on property located in an R-5 <br /> zoning district at 45 Hooppole Road (Map 64 , Block 19 ) <br /> Mashpee , MA. ( Owner of record: Daniel E . Caggiula) . <br /> Notice was duly given to abutters in accordance <br /> with Massachusetts General Laws Chapter 40A. Notice was <br /> given by publication in The Enterprise , a newspaper of <br /> general circulation in the Town of Mashpee on September 23 <br /> and September 30 , 1994 , a copy of which is attached hereto <br /> and made a part hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, October 12 , 1994 at 7 : 30 <br /> P .M. at which time the following members of the Board of <br /> Appeals were present and acting throughout : Edward M. <br /> Govoni, James E. Regan III and John J . Friel . <br /> Engineer John Slavinsky represented the applicant <br /> and presented plans for the relocation of an existing <br /> dock . The dock will be 56 ' long and has been approved by <br /> the Conservation Commission. No comments were received <br /> from the Harbormaster or Shellfish constable . <br />
