Hendricks - SP-94-80 <br /> A Petition was filed by Curtis L. Hendricks of <br /> Mashpee, Massachusetts on September 27 , 1994 for a Special <br /> Permit under Section 174-20 of the Zoning By-laws to allow <br /> the reconstruction of a non-conforming garage/apartment <br /> which was damaged by fire on property located in an R-5 <br /> zoning district at 28 Great Neck North (Map 36 , Block 17 ) <br /> Mashpee, Massachusetts . ( Owner of record: Susan M. <br /> Hendricks ) . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee , on October 7 and October <br /> 14 , 1994 , a copy of which is attached hereto and made a part <br /> hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, October 26, 1994 at 7 : 30 <br /> P .M. at which time the following members of the Board of <br /> Appeals were present and acting throughout : Edward M. <br /> Govoni , James E . Regan III and Robert G. Nelson. <br /> Mr . Hendricks informed the Board that he was planning <br /> to rebuild the damaged garage on the same footprint but with <br /> a change in the roofline . No . comments were received from <br /> abutters . <br /> The Board found that the garage/apartment is a <br /> pre-existing non-conforming structure. The Mashpee By-law <br /> ' allows the rebuilding of such structure damaged by fire <br /> subject to approval by the Board of Appeal's . <br /> Upon motion duly made and seconded the Board of <br /> Appeals voted unanimously on October 26 , 1994 to grant the <br /> Special Permit . The Board found that the proposed <br /> construction would not be a detriment to the Town and' <br /> complies with the by-laws . <br />
