Board of Appeals- Richardson Jonas V-94-72 2 . <br /> Findings : <br /> a. General <br /> 1 . the subject property consists of <br /> seven lots located at the end of Jonas Drive . <br /> These lots are identified as Lots 24, 25 , 26 , 27 , <br /> 29 , 30 and 31 shown on a 1985 subdivision plan <br /> recorded at the Barnstable County Registry of Deeds <br /> in Plan Book 438 , Page . 38 . <br /> 2 . the Jonas Drive subdivision plan, <br /> consisting of eight lots, was originally submitted <br /> to the Mashpee Planning Board as a preliminary <br /> plan . At the time of the submission of the <br /> preliminary plan, the minimum lot size requirement <br /> for the R-2 district in which the subdivision is <br /> located was 22 , 500 square feet. <br /> 3 . between the date of the submission of <br /> the preliminary plan and the date of the approval <br /> of the definitive subdivision plan for Jonas Drive , <br /> the minimum lot area requirement for the R-2 <br /> 'district was increased to 40 , 000 square feet. <br /> Subsequently, the minimum lot size has been durther <br /> increased to 80 , 000 square feet . <br /> 4 . The subject lots do not meet the <br /> present 80 , 000 square foot area requirement : The <br /> lot sizes are as follows : <br /> Lot t Area <br /> 24 22 , 571 square feet <br /> 25 27 , 570 square feet <br /> 26 35, 190 square feet <br /> 27 26 , 871 square feet <br /> 29 16 , 946 square feet <br /> 30 45, 441 square feet <br /> 31 39 . 075 square feet <br /> 5 . Pursuant to G.L. c . 40A Section 6 , the <br /> subject lots were protected from the applicability <br /> of the lot area increases adopted after the filing <br /> of the preliminary sudvision plan for the period <br /> during which the plan was being processed and for <br /> N eight years from the date of endorsement of <br /> approval on the plan . <br />
