1`�tirn�v4o '1 <br /> r= i Town of ;ffia obpee RECEIVED � <br /> \' �• 16 GREAT NECK ROAD NORTH OD NOQ/ 204 <br /> BOARD MA APPEALS TOWN CLERK F , <br /> HP <br /> Decision for a Special Permit <br /> RE: Liberty Liquors for a Special Permit SP-94-87 <br /> A Petition was filed by Liberty Liquors Inc . for a <br /> Special Permit under Sections 174-51 .D and 174-55 .B to <br /> allow for two exterior signs exceeding 20 square feet on <br /> Building E6 at North Market Street/Mashpee Commons . The <br /> property is located in a C-1 zoning district at 39 Nathan <br /> Ellis Highway, Map 74 , Block 22 ) Mashpee, MA. ( Owner of <br /> record: North Market Street Assoc . Ltd. ) . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General 'Laws Chapter 40A. Notice was given <br /> by publication in The Enterprise , a newspaper of general <br /> circulation in the Town of Mashpee, on October 25 and <br /> November 1 , 1994 , a copy of which is attached hereto and <br /> made a part hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, November 9 , 1994 at 7 : 30 <br /> P .M. at which time the following members of the Board of <br /> Appeals were present and acting throughout : Edward M. <br /> Govoni , James E. Regan III and Kenneth E . Marsters . <br /> John Rentz of Fields Point and Steven C. Purcell <br /> represented the applicants . Mr . Rentz reviewed a model of <br /> the North Market Street Shopping Center showing the <br /> buildings which would be built opposite the subject <br /> property. He explained that the height of the buildings <br /> across the street would block view from the rear of the <br /> lot . He explained that Liberty Liquors is renting three of <br /> four possible stores in the building and the architecture <br /> has been designed with four bays . Mr . Purcell reviewed <br /> the design of the signs which would be placed on the east <br /> and west sides of the building . The signs have been <br /> approved by the Design Review Committee . <br /> Upon motion duly made and seconded the Board of <br /> Appeals voted unanimouly on November 9 , 1994 to grant the <br /> Special Permit to allow for two exterior signs of 60 square <br /> feet each on the east and west side of the building . Each <br /> sign is made for three distinct bays . The Board found <br /> that the signs were not a detriment to the area and <br /> complied with the provisions of the By-laws . The signs are <br /> not on top of the building and will be blocked by the <br /> proposed building across North Market St . The permit is <br /> referenced by plans of Steven Purcell signed October , 1994 . <br />
