I have only three comments.
One is to emphasize -that the isolated lot exemption requires
that a lot of at least fifty feet of frontage and five thousand
square feet of area also have conformed fully to the zoning by-
law in effect at the time the by-law was first amended to make
the lot nonconforming. Also, I would emphasize that the five year
protection period I noted at page 7 of the Minutes extends only
to three such lots. The last comment is to clarify that the case
to which I referred at page 6 of the Minutes is the case Sieber
v. Zoning Board of Anneals of Wellfleet, 16 Mass. App. Ct. 985
(1983). I have enclosed a copy for your reference as well as a
copy of a legal memorandum which I wrote on the subject of
isolated lots. Although written in 1985, it is still pertinent
and attaches another important case, Adamowicz V. Town of
Ipswich, 395 Mass. 757 (1989), which explains in more detail the
relevant date for purposes of the isolated lot exemption.
EAL/j a
Enc.
cc: Board of Selectmen
Ve // truly your/s p
Eliza beth A.
