5. <br />Mr. Makunas: "You refer to Variances as difficult to <br />• justify. Have you found that Boards use the Variance process <br />as long as nobody is going to be hurt by it and nobody is going <br />to challenge it?" <br />Ms. Lane: some Boards think that their reason for being <br />is to give relief to people. That's not really what a Board <br />is for and other Boards get a lot of pressure because again <br />and again they are asked for a certain kind of Variance.... <br />if you're in that position you probably need to rewrite the <br />zoning by-law. There is something wrong with the by-law because <br />people cannot live under it... it can be difficult to make the <br />findings." <br />Mr. Makunas: "Sometimes everyone wants them to do it ... <br />the neighbors will come in supporting this... what are you going <br />to do.?" <br />Ms. Lane: "one thing is to look carefully and make sure <br />it is not an isolated lot. If it is an isolated lot you can <br />get off the hook if they meet the area, frontage...." <br />Mr. Makunas: "in that case, we deny the request and refer <br />them to the Building Inspector. Do we make a judgment?" <br />Ms. Lane: "Yes, you should deny it." <br />• Mr. Makunas: Should we deny it and say that it is an <br />isolated lot and we believe it doesn't need a Variance." <br />Ms. Lane: "You can say that but it is not binding. They <br />cannot come to you for declaratory judgments." <br />Mr. Makunas: "Can they run to the Building Inspector and <br />ask for a building permit?" <br />Ms. Lane: "if he concurs. The facts of whether this lot <br />was created on a certain date may be difficult for you to get <br />out at a hearing. They may not have all of those facts." <br />Mr. Hauck: "A lot of the lots that we have problems with <br />are the older, smaller lots that they want Variances for but <br />ifwe go with the zoning at the time we may not need Variances. <br />Ms. Lane: "if they complied with the separate lot <br />requirement... if it was held separately when it was created." <br />Mr. Hauck: "I have been requiring deed searches on that <br />lot and all contiguous lots to determine separate ownership." <br />Ms. Lane: "You want to focus on the date of the by-law <br />change." <br />
