TOWN OF MASHPEE <br />• Board of Appeals <br />Minutes <br />February 10, 1993 <br />The Mashpee Board of Appeals held a meeting on Wednesday, <br />February 10, 1993 at 7:30 P.M. at the Mashpee Town Hall. Board <br />members present were John J..Friel, Chairman; Michael A. Makunas, <br />Vice Chairman; Edward Govoni, Clerk and.Associate Members Cheryl A. <br />Hawver and Jamie Regan. Associate Member Arnold Mindick was absent. <br />Building Inspector William Hauck was in attendance. <br />Dante A. Brossi - Requests a Variance from Section 174-31 of the <br />Zoning By-laws for permission to vary the side and rear setback and <br />lot coverage requirements in an R-3 zoning district on property <br />located at 9 Uncle Henry's Road (Map 117, Block 285) Mashpee, MA. <br />(Owner of record: Dante A.'and Emma E. Brossi). <br />Dante A. Brossi - Requests a Special Permit under Section 174-17 <br />of the Zoning By-laws for permission to expand an existing non -conforming <br />dwelling with an addition to the dwelling and a deck in an R-3 zoning <br />district on property located at 9 Uncle Henry's Road (Map 117, Block <br />• 285) Mashpee, MA. (Owner of record: Dante A. and Emma E. Brossi). <br />Members sitting: J. Friel, E. Govoni, J. Regan <br />Engineer John Slavinsky represented the applicant. He presented <br />plans for a house addition and a deck and explained that the deck <br />would be 6.6' from the rear property.line. He said owner was planning <br />to upgrade the septic system.Mr. Friel reviewed a memo from Bill <br />Hauck stating that the lot and house predated zoning and, therefore, <br />there were no setback requirements. Mr. Friel read a letter from <br />an abutter, Anthony J. Raimondi, stating that the adjacent lot had <br />been declared a wetlands and that no construction can proceed within <br />the 100' buffer zone. Mr. Slavinsky said this was not considered <br />a wetland under state regulations. <br />Mr. Friel stated that since this lot predated zoning a Variance <br />was not required. Mr. Friel moved to grant the Special Permit. <br />Mr. Regan seconded. All agreed. <br />Ms. Hawver reviewed the Board of Health requirements and Mr. Slavinsky <br />said that both Board of Health and Conservation would be involved <br />before a building permit could be issued. <br />Mr. Friel moved that the Board has determined that the request for <br />a Variance is not needed'in this application.Mr. Govoni seconded. <br />All agreed. <br />0 <br />
