i <br />TOWN OF MASHPEE <br />Board of Appeals <br />Minutes <br />Wednesday, April 28, 1993 <br />The Mashpee Board of Appeals held a meeting on Wednesday, <br />April 28, 1993 at 7:30 P.M. at the Mashpee Town Hall. <br />Board members present and acting throughout were: John J. <br />Friel, Chairman; Michael A. Makunas, Vice Chairman; Edward <br />M. Govoni, Clerk; and Jamie Regan, Associate Member. <br />Building inspector William F. Hauck was in attendance. <br />Joseph and Maria Rintone - Request a Special Permit under <br />Section 174-25.2.9 of the Zoning By-laws for permission to <br />construct a pier, ramp and float on the Mashpee River on <br />property located in an R-3 zoning district at 52 Old Dock <br />Lane (Map 96, Block 110) Mashpee, MA. (Continued from <br />March 10, 1993). <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />• Engineer Douglas Cameron represented the applicant and <br />explained that the proposed pier will provide access over <br />the wetlands and eliminate the need for a mooring. He said <br />the structure is elevated to provide access along the <br />shore. He said that the Conservation Commission was having <br />a shellfish survey done 300' up the river for Baybury <br />Village and reviewed the Punkhorn Point dock which is <br />limited to dinghy use. He explained that Mr. Rintone is <br />the only owner with direct waterfront access. <br />Mr. Rintone submitted copies of the deed and covenants for <br />Punkhorn Point which had no restrictions on use. This was <br />in rebuttal to comments submitted from T. Fudala who had <br />stated that only one dock was allowed. Mr. Cameron stated <br />that there would be no negative impact to environmental <br />resources. Mr. Friel questioned location of other docks in <br />the area. Mr. Rintone reviewed the other docks in the area <br />and explained that the shallowness of the river controlled <br />the boat traffic. <br />Mr. Makunas moved to grant the Special Permit. Mr. Govoni <br />seconded. All agreed. <br />• <br />
