i TOWN OF MASHPEE Board of Appeals Minutes Wednesday, April 28, 1993 The Mashpee Board of Appeals held a meeting on Wednesday, April 28, 1993 at 7:30 P.M. at the Mashpee Town Hall. Board members present and acting throughout were: John J. Friel, Chairman; Michael A. Makunas, Vice Chairman; Edward M. Govoni, Clerk; and Jamie Regan, Associate Member. Building inspector William F. Hauck was in attendance. Joseph and Maria Rintone - Request a Special Permit under Section 174-25.2.9 of the Zoning By-laws for permission to construct a pier, ramp and float on the Mashpee River on property located in an R-3 zoning district at 52 Old Dock Lane (Map 96, Block 110) Mashpee, MA. (Continued from March 10, 1993). Members sitting: J. Friel, M. Makunas, E. Govoni • Engineer Douglas Cameron represented the applicant and explained that the proposed pier will provide access over the wetlands and eliminate the need for a mooring. He said the structure is elevated to provide access along the shore. He said that the Conservation Commission was having a shellfish survey done 300' up the river for Baybury Village and reviewed the Punkhorn Point dock which is limited to dinghy use. He explained that Mr. Rintone is the only owner with direct waterfront access. Mr. Rintone submitted copies of the deed and covenants for Punkhorn Point which had no restrictions on use. This was in rebuttal to comments submitted from T. Fudala who had stated that only one dock was allowed. Mr. Cameron stated that there would be no negative impact to environmental resources. Mr. Friel questioned location of other docks in the area. Mr. Rintone reviewed the other docks in the area and explained that the shallowness of the river controlled the boat traffic. Mr. Makunas moved to grant the Special Permit. Mr. Govoni seconded. All agreed. •
