Board of Appeals <br />• Members sitting: <br />• <br />Minutes - May 12, 1993 <br />J. Friel, M. Makunas, E. Govoni <br />3. <br />Edward McGuire, Environmental Consultant Bob Gray and <br />Engineer Stephen A. Haas represented the applicant. Mr. <br />McGuire explained that his family owned two lots with docks <br />which had been built in the 19501s. He said they had three <br />docks which were damaged in Hurricane Bob. They wish to <br />replace two of them and have received Conservation approval. <br />He said the Building Inspector had informed them that they <br />did not meet setback requirements and needed variances. One <br />dock is 10' from the lot line and the other is 5'. He <br />presented pictures of the docks before the hurricane. Mr. <br />Gray said that they have to license in the footprint at the <br />time of the hurricane. Mr. Govoni noted that the lots <br />predated zoning and did not have setback requirements. <br />Mr. Govoni moved to grant the Special Permit for the dock, <br />ramp and float at 410 Monomoscoy Road noting that the dock <br />was built before zoning and that there were zero sideline <br />setback requirements and that a Variance is not required. <br />The Special Permit allows a 7' sideline setback from the <br />float to the lot line. Mr. Makunas seconded. All agreed. <br />Mr. Govoni moved to grant the Special Permit for the dock, <br />ramp and float at 414 Monomoscoy Road noting that the dock <br />was built before zoning and that there were zero sideline <br />setback requirements and that a Variance is not required. <br />The Special Permit allows a 1' sideline setback from the <br />float to the lot line. <br />Discussion - Mr. Friel announced that the secretary's <br />position had been upgraded at Town Meeting. <br />Mr. Friel announced that the May 26 meeting of the Board <br />would be cancelled. The next meetings will be June 9 and <br />June 23. He said the Board might meet once in July and <br />August depending on the number of applications. <br />There was discussion that new docks over 70' will require <br />Special Permit and Variances. <br />Attorney Mark Gildea - Mr. Friel informed the Board that the <br />Board had received a request for a 60 -day extension on the <br />Appeal of the Building Inspector by New Seabury. Mr. Makunas <br />moved to accept the request for an extension. Mr. Govoni <br />seconded. All agreed. <br />
