f, <br />TOWN OF MASHPEE <br />• Board of Appeals <br />Minutes <br />Wednesday, June 30, 1993 - 7:30 P.M. <br />The Mashpee Board of Appeals held a meeting on Wednesday, June <br />30, 1993 at 7:30 P.M. at the Mashpee Town Hall. Board members <br />present were: John J. Friel, Chairman; Michael A. Makunas, <br />Vice Chairman and Edward M. Govoni, Clerk. Building Inspector <br />William Hauck was in attendance. <br />Fields Point Ltd. Partnership - Requests a Variance from Sections <br />174-451/174-45.I.c for permission to vary the setback <br />requirements for commercial centers in a C-1 zoning district <br />on property located at 39 Nathan Ellis Highway (Map74, Block <br />22) Mashpee, MA. <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />Douglas Storrs of Fields Point represented the applicant. Mr. <br />Makunas asked if this application was exactly the same as a <br />Variance granted earlier in the year under another section of <br />the by-law. Mr. Storrs replied that it was a repetition in <br />the by-law. He said he wished he had the time to identify some <br />of the problems in the by-laws to correct them at Town meeting. <br />Mr. Makunas moved to grant the request for a Variance. He said <br />wording would be the same as V-93-5 with the change only in <br />the reference to the Sections of the by-laws. Mr. Friel <br />seconded. All agreed. <br />Attorney Elizabeth Lane joined the meeting at 7:45 <br />Attorney Lane reviewed some of the memoranda from Koppelman <br />and Paige and distributed new copies. <br />Mr. Friel asked for costs in reviewing by-laws and recommending <br />improvements. Ms. Lane agreed that some of the by-laws were <br />misleading. Ms. Lane said the best way would be to address <br />some of the specific problems rather than a broad overview. <br />She mentioned that accessory uses, for example, are not included <br />in the use tables. She suggested developing a list of problem <br />areas. <br />Ms. Lane suggested improvements in the use tables particularly <br />within shopping centers. Mr. Govoni questioned why special <br />permits were required for permitted uses in commercial districts. <br />There was discussion of changes in the by-laws in the authority <br />to grant Special Permits. Bill Hauck discussed the Plan Review <br />• process and that it should be revised. Ms. Lane said Plan Review <br />could be used in changing from one retail use to another. Mr. <br />Hauck said the procedure in Plan Review was more complicated <br />
