1 <br />• TOWN OF MASHPEE <br />Board of Appeals <br />Minutes <br />Wednesday, September 8, 1993 <br />The Mashpee Board of Appeals held a meeting on Wednesday, <br />September 8, 1993 at 7:30 P.M. at the Mashpee Town Hall. <br />Board member present and acting throughout was Vice <br />Chairman, Michael A. Makunas. Chairman John J. Friel was <br />present for all hearings except William S. Ricci. Clerk <br />Edward Govoni was present for the William S. Ricci and E. <br />Thomas Jones hearings. Associate Member Jamie Regan was <br />present for all hearings except E. Thomas Jones. <br />William S. Ricci: Requests a Special Permit under Section <br />174-17 of the Zoning By-laws for permission to expand a <br />non -conforming dwelling with a first floor addition in an <br />R-3 zoning district on property located at 3 Shore Drive <br />(Map 112, Block 96) Mashpee, MA. <br />Members sitting: M. Makunas, E. Govoni, J. Regan <br />Mr. Ricci represented his application and explained that he <br />wished to enclose a 9' x 14' area for a laundry. No <br />• comments were received from abutters. <br />Mr. Govoni moved to grant the Special Permit. Mr. Regan <br />seconded. All agreed. <br />E. Thomas Jones: Requests a Special Permit under Section <br />174-17 of the Zoning By-laws for permission to build on a <br />non -conforming lot in an R-3 zoning district on property <br />located at 202 Daniel's Island Road (Lots 30 and 31 on Land <br />Court Plan 11408 and included in Map 100, Block 23) <br />Mashpee, MA. (Owner of record: Edward E. Jones). <br />Members sitting: J. Friel, M. Makunas, E. Govoni <br />Jamie Regan stepped down from the Board and left the room. <br />Attorney Robert Clark represented the applicant. He <br />explained that Mr. Jones purchased 3 parcels of land by 2 <br />deeds in 1960. One deed is for the house and lot and the <br />other for 2 lots on which there is now an infringement of a <br />part of the garage. He stated that the matter was brought <br />before the Board in 1991 to determine if the vacant lot was <br />buildable and the former Building Inspector said there was <br />not enough frontage and Mr. Jones withdrew the application. <br />He said that the present Building Inspector informed them <br />. that Section 174-31 Footnote 1 allows 60' frontage on a cul <br />de sac. Mr. Clark said that the garage would be removed if <br />a Special Permit was granted. <br />
