Talanian - Requests a Special Permit under
Section 174-25.B.14 of the Zoning By-laws to relocate and
improve the existing miniature golf facility situated at the
corner of Route 28 and Donna's Lane (Map 81, Block 4) to
property located in a C-1 zoning district at 694 Falmouth
Road (Map 81, Block 25) Mashpee, MA. Govoni, J. Regan
Attorney Kevin Kirrane explained that the relocation of the
miniature golf course was necessitated by the eminent domain
taking for the construction of Donna's Lane and that the
Selectmen had permitted use of the land for 1993. He said he
would leave it to the Town to decide the appropriate
permitting board but explained that the proposed site was
only 3 acres of usable land due to the impact of
Commonwealth Edison easements. Land Planner Michael Aucoin
reviewed proposed uses on the site.
Mr. Friel stated that he felt Town Counsel should define the
appropriate permitting board. He said he felt the
application should be referred to the Cape Cod Commission.
Mr. Kirrane said they were relocating an existing use which
has been in place for 30 years.
Mr. Friel moved to suspend the hearing and forward the
application to the Cape Cod Commission. Mr. Govoni
seconded. All agreed.
