r. <br /> 4; Tobin of Aaobpee <br /> 16 GREAT NECK ROAD NORTH <br /> „Y`' MASHPEE, MA 02649 <br /> T�s�e co e <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Cape Feed and Garden Supplies for a Special Permit - SP-93-3 <br /> A Petition was filed by Cape Feed and Garden Supplies of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-25.F.5 of the <br /> Zoning By-laws for the outdoor sale of flowers, garden supplies and <br /> agricultural produce in a C-2 zoning district on property located at <br /> 451 Nathan Ellis Highway (Map 72, Block 1) Mashpee, Massachusetts. <br /> (Owners of record: Kenneth A. Gray and Patricia A. Govoni TRS. ) <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on January 8 and January 15, 1993, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, January 27, 1993 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas, and Jamie Regan. <br /> Attorney Kevin M. Kirrane represented the Applicant and reviewed <br /> plans for the outdoor sale of flowers, garden supplies and agricultural <br /> produce. He presented detailed plans of the mobile carts which will be <br /> used for sales of produce. A Petition was received with signatures of <br /> 1.15 residents in favor of the application and the Design Review Committee <br /> had approved the design and the Department of Public Works noted that <br /> the parking requirements had been met. <br /> The Board found that the use is in harmony with the general purpose <br /> and intent of the By-laws and complies with the provisions therein. The <br /> Board determined that the proposal will not adversely impact any of the <br /> interests intended to be protected by local zoning and will not be a <br /> detriment to the surrounding neighborhood. <br />
