Nep 0�1 6A <br /> _ Tobin of Oaobpee <br /> \' 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> �.�._ ••FAY . <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Laura Kanter for a Variance - V-93-6 <br /> A Petition was filed by Laura Kanter of Mashpee, Massachusetts <br /> for a Variance from Sections 174-31, 174-21C and 174-32 of the <br /> Zoning By-laws for permission to vary the lot frontage requirements <br /> and allow construction on a dirt road in an R-3 zoning district on <br /> property located at 9 Kanter Lane (Map 117, Block 1D) Mashpee, <br /> Massachusetts. <br /> Notice was.,duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on January 8 and January 15, 1993, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on. Wednesday, January 27, 1993 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Jamie Regan. <br /> Dr. Stanley Kanter represented the applicant and presented plans <br /> of a 1969 ANR subdivision which included a lot with 20' frontage. <br /> The Board received comments from the Fire Department stating that the <br /> road provided adequate access for Fire Department vehicles. <br /> The Board determined that shape of the lot created a hardship <br /> affecting the land in question but not the zoning district_in which-it <br /> was located and that relief could be granted without derogating from <br /> the intent of the by-law or without detriment to the public good. <br />
