Nep 01 6A
_ Tobin of Oaobpee
\' 16 GREAT NECK ROAD NORTH
MASHPEE, MA 02649
.._ ••FAY .
BOARD OF APPEALS
DECISION
FOR A VARIANCE
RE: Laura Kanter for a Variance - V-93-6
A Petition was filed by Laura Kanter of Mashpee, Massachusetts
for a Variance from Sections 174-31, 174-21C and 174-32 of the
Zoning By-laws for permission to vary the lot frontage requirements
and allow construction on a dirt road in an R-3 zoning district on
property located at 9 Kanter Lane (Map 117, Block 1D) Mashpee,
Massachusetts.
Notice was.,duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee,
on January 8 and January 15, 1993, a copy of which is attached hereto
and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town
Hall on. Wednesday, January 27, 1993 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: John J. Friel, Michael A. Makunas and Jamie Regan.
Dr. Stanley Kanter represented the applicant and presented plans
of a 1969 ANR subdivision which included a lot with 20' frontage.
The Board received comments from the Fire Department stating that the
road provided adequate access for Fire Department vehicles.
The Board determined that shape of the lot created a hardship
affecting the land in question but not the zoning district_in which-it
was located and that relief could be granted without derogating from
the intent of the by-law or without detriment to the public good.
