i <br /> t <br /> "F lON\4 <br /> `'"� � zobnn of Aubpee <br /> •� '• ;; 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> TABU:C�' <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Gladwin Trott for a Variance V-93-14 <br /> A Petition was filed by Gladwin Trott of Mashpee, Massachusetts <br /> for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the side line setback in an R-5 zoning district on property <br /> located at 46 Meadow Haven Drive (Map 47, Block 46) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on January 26 and February 2, 1993, a copy of which is attached <br /> hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, February 10, 1993 at' 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. .Makunas and Edward M. Govoni. <br /> Barry Keene, Builder, represented Mr. Trott and present plans for <br /> a house, addition. He explained that the topography of the lot and the <br /> location of the septic system prevented additions at any other location.. <br /> The Board found that the topography of the lot created a hardship <br /> affecting the land in question but not the zoning district in which it <br /> was located. The Board determined that relief could be granted without <br /> derogating from the intent of the by-laws or without detriment to the <br /> public good. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on February 10, 1993 to grant a Variance of 3.2' on the <br /> North side resulting in a side line setback of 11.8' . The Variance <br /> is referenced by plans of Weller and Associates dated November 12, 1992. <br />
