Mown of ftlazbpee <br /> \' %• 16 GREAT NECK ROAD NORTH <br /> e'q MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: David H. and Donna Parsons TRS. for a Special Permit SP-93-19 <br /> A Petition was filed by David H. and Donna Parsons TRS. of <br /> Mashpee, Massachusetts for a Special Permit under Section 174-25.I.9 <br /> of the Zoning By-laws for an existing seasonal pier in John's Pond on <br /> property located at 229 Hooppole Road (Map 49, Block 205) Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 19 and February 26, 1993, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town_ <br /> Hall on Wednesday, March 10, 1993 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Cheryl A. Hawver. <br /> Engineer Christopher Costa represented the applicants and <br /> explained that the Special Permit was required in the amnesty <br /> program for the licensing of existing piers. No comments were <br /> received from abutters. <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously to grant the Special Permit. The permit is <br /> referenced by plans of Christopher Costa dated September 1, 1992 <br /> subject to any revisions requested by the Conservation Commission. <br /> The Board found that the use was in harmony with the general <br /> purpose and intent of the by-laws and complied with the provisions <br /> therein. The Board determined that. the structure would not interfere <br /> with free passage of travel by water or land orrcause disruption to <br /> the marine or coastal environment. <br />
