MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Joseph Rintone for a Special Permit - SP793-15 <br /> A Petition was filed by Joseph Rintone of Mashpee, Massachusetts <br /> for a Special Permit under Section 174-25.I.9 of the Zoning By-laws <br /> for permission to construct a pier, ramp and float on the Mashpee <br /> River on property located in an R-3 zoning district at 52 Old Dock <br /> Lane (Map 96, Block 110) Mashpee, Massachusetts. (Owners, of record: <br /> Joseph P. and Maria Rintone) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 19 and February 26, 1993, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition on Wednesday, March 10, <br /> 1993 at 7:30 at the Mashpee Town Hall at which the applicant requested <br /> a continuance to April 28, 1993. A Public Hearing was held on the <br /> Petition on Wednesday, April 28, 1993 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Engineer Douglas Cameron represented the applicant and explained <br /> that the proposed pier will provide access over the wetlands and <br /> eliminate the need for a mooring. He informed the Board that the <br /> structure will be elevated to provide access along the shore. <br /> Mr. Rintone submitted copies of his deed and the covenants for <br /> Punkhorn Point which had no restrictions on the use of his land for <br /> a dock. <br /> The Board found that the structure will not interfere with free <br /> passage of travel by water or land or cause or contribute to the <br /> disruption of the coastal environment. The Board determined that <br /> the use is in harmony with the purpose and intent of the by-laws and <br /> i <br /> complies with the provisions therein. <br />
