Lyons for a Special Permit SP-93-16 A Petition was filed by Joyce M. Lyons of East Falmouth, Massachusetts for a Special Permit under Section 174-25.F.5.of the Zoning By-laws for permission to operate a fruit and vegetable stand outside of the Picnic Box Restaurant in a C-1 zoning district at 518, 528 and 538 Falmouth Road (Map 74, Block 16) Mashpee, MA. (Owner of record: Fields Point Ltd. Partnership) . Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee on February 19 and February 26, 1993, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, March 10, 1993 at 7:30 P.M. and continued on Wednesday, March 24, 1993 at 7:30 P.M. at which times the following members of the Board of Appeals were present and acting throughout: John J. Friel, Michael A. Makunas and Cheryl A. Hawver. Attorney Mark Gildea represented the Applicant and informed the Board that the applicant would improve the black top in the area of the Picnic Box. The Board requested that he work with the Director of Public Works, R. Gregory Taylor, to improve access to the site. At the March 24, 1993 meeting Mr. Gildea presented a traffic plan which would allow an entrance to the site from the Rotary but exits would be from other curb cuts. Upon motion duly made and seconded the Board of Appeals voted unanimously on March 24, 1993 to allow the use based on the restrictions of traffic direction on signed plans. The Permit is conditioned that there be no outside sales until repairs are completed and handicapped parking provided.
