Lyons for a Special Permit SP-93-16 <br /> A Petition was filed by Joyce M. Lyons of East Falmouth, <br /> Massachusetts for a Special Permit under Section 174-25.F.5.of <br /> the Zoning By-laws for permission to operate a fruit and vegetable <br /> stand outside of the Picnic Box Restaurant in a C-1 zoning district <br /> at 518, 528 and 538 Falmouth Road (Map 74, Block 16) Mashpee, MA. <br /> (Owner of record: Fields Point Ltd. Partnership) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 19 and February 26, 1993, a copy of which is attached <br /> hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 10, 1993 at 7:30 P.M. and continued on <br /> Wednesday, March 24, 1993 at 7:30 P.M. at which times the following <br /> members of the Board of Appeals were present and acting throughout: <br /> John J. Friel, Michael A. Makunas and Cheryl A. Hawver. <br /> Attorney Mark Gildea represented the Applicant and informed <br /> the Board that the applicant would improve the black top in the <br /> area of the Picnic Box. The Board requested that he work with the <br /> Director of Public Works, R. Gregory Taylor, to improve access to the <br /> site. At the March 24, 1993 meeting Mr. Gildea presented a traffic <br /> plan which would allow an entrance to the site from the Rotary but <br /> exits would be from other curb cuts. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on March 24, 1993 to allow the use based on the restrictions <br /> of traffic direction on signed plans. The Permit is conditioned that <br /> there be no outside sales until repairs are completed and handicapped <br /> parking provided. <br />
